Terms of Sale
These terms apply to every order placed on sculptavi.shop. Please read them before you buy; you accept them when you tick the box at checkout.
Last updated: 12 October 2026
1. Who we are
The shop is operated by SIESTA LLC, a Florida limited liability company trading as SCULPTAVI, 1320 Stirling Road, Suite 5A, Dania Beach, FL 33004, United States (“we”, “us”). Email support@sculptavi.shop, telephone +1 8525654215. Company details are on our Legal Information page.
2. Who can buy
We sell to consumers buying for their own use, aged 18 or over, with a delivery address in one of the countries listed on our Shipping page. We do not sell for resale.
3. The products
Each product page describes the piece, its material, size, brim capacity and what is included (for example, “Pair (2 cups)”). Photographs show the design; glaze tone, drip lines and small surface marks vary slightly between pieces and are not defects. Items shown alongside a product in a photograph are not included unless listed under “In the box” or “You receive”.
4. Prices and currency
Prices are shown in the currency you choose (USD, EUR, GBP, DKK, SEK, NOK, CHF or CAD), with the currency code next to every amount. Prices in currencies other than US dollars are set by us from our US dollar prices using exchange rates we review regularly. Your order is charged in the currency shown at checkout, and the total at checkout is the amount we charge.
Prices do not include US sales tax, import VAT, customs duties or carrier customs fees. US sales tax is added at checkout where we are required to collect it. For deliveries outside the United States, import charges may be collected by the carrier or customs on delivery; see Shipping. Shipping costs are shown before you pay.
If a price on the site is obviously wrong because of a technical or typing error, we will tell you and you may confirm the order at the correct price or cancel it for a full refund.
5. How the contract is made
Product pages are an invitation to order. When you click “Place order and pay”, you make a binding offer to buy the items in your bag. We confirm receipt of your order by email straight away; this confirmation does not yet accept your order. The contract is concluded when we send you the dispatch email, or at the latest when we deliver the goods. We store the text of the contract and send you the order details by email; you can also see them in your account if you created one. The contract language is the language of the site version you ordered in; these terms are available in English and the other languages of the site.
You can correct any input errors in your bag and on the checkout page before you place the order.
6. Payment
You pay when you place the order, by card or PayPal through our payment providers, using the methods shown at checkout. Card details are entered on secure forms provided by our payment providers, who are certified to the PCI DSS standard; we never receive or store your full card number. If a payment is declined or reversed, we may cancel the order.
7. Delivery
We dispatch within 1–3 business days and deliver to the address you give us. Delivery times on our Shipping page are estimates. The risk of loss or damage passes to you when the goods are delivered to you or to a person you name (other than the carrier). If a parcel arrives damaged, please follow the steps on the Shipping page.
8. Returns and right of withdrawal
You can return unused pieces within 30 days of delivery under our return promise. If you live in the EU, EEA or UK you have a statutory right to withdraw from the contract within 14 days without giving a reason. Conditions, the model withdrawal form and the online withdrawal function are described on Returns & Withdrawal, which forms part of these terms.
9. Cancellation of an order
You may cancel an order that has not yet been dispatched by emailing us; we refund you in full. We may cancel an order before dispatch if a product is unavailable, the price was obviously wrong, or payment could not be verified; we then refund any amount paid in full.
10. Faulty goods and legal guarantee
We are responsible for delivering goods that match their description and are free of defects. If you live in the EU, EEA or UK, the statutory legal guarantee of conformity applies (at least two years from delivery); you can choose repair or replacement, and in some cases a price reduction or refund. If you live in the United States, the implied warranties under the law of your state apply. Our own promises (such as replacing pieces broken in transit) are in addition to these rights and never limit them.
11. Promotions
We do not currently run promotions, discount codes or free trials. If we offer one, its conditions will be shown next to the offer and apply only to that offer.
12. Intellectual property
The designs, photographs, texts and the SCULPTAVI name on this site belong to us or our licensors. You may not copy them for commercial use without our written permission.
13. Liability
We are liable without limitation for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional or grossly negligent conduct, and wherever liability cannot be limited by law. Otherwise our liability for any order is limited to the price you paid for that order and to losses that were foreseeable when the contract was made. We are not liable for business losses. Some states and countries do not allow certain limitations, so parts of this section may not apply to you.
14. Disputes
If something goes wrong, please contact us first at support@sculptavi.shop; most problems are solved within a few days.
Customers in the United States: arbitration and class action waiver. Any dispute between you and us relating to an order or these terms that we cannot resolve informally will be resolved by individual binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, not in court and not as a class action. Either of us may instead bring an individual claim in small claims court. You can opt out of this arbitration agreement by emailing support@sculptavi.shop within 30 days of first accepting these terms, with your name and the words “arbitration opt-out”. Opting out does not affect any other part of these terms.
Customers in the EU, EEA, UK and Switzerland. The arbitration clause does not apply to you. You may bring proceedings in the courts of the country where you live. We are not willing or obliged to take part in dispute resolution proceedings before a consumer arbitration board.
15. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules. If you are a consumer living outside Florida, you also keep the protection of the mandatory consumer laws of the place where you live.
16. Changes
We may update these terms. The version that applies to your order is the one shown on the site when you placed it.
